Pre-Divorce Checklist

These 8 Steps Could Save You a Lot Time, Money, and Frustration

Below is the free, no-obligiation pre-divorce checklist from Maceau Law, Colorado Springs, CO, to best ready you for a divorce no matter what stage you’re in the legal separation process. The checklist covers several things you might not have thought about:

  1. MaceauLawLogoNon-breadwinners should save up monies from the joint bank account and other assets in case the breadwinner closes bank accounts and withdraws financial support after filing for divorce (it happens a lot!);
  2. Locate all asset and debt documentation before filing for divorce. Sometimes the other spouse will hide documentation after the divorce is filed (this happens a lot too!);
  3. Have any agreements regarding parenting time, parenting responsibilities, spousal maintenance, child support, division of property, etc. in writing whether it be email, text message, or wet paper, i.e. pen and paper;
  4. Prepare emotionally for the ups and downs of a divorce. It’s not easy but if you prepare your heart, it will be easier;
  5. If there is any type of physical abuse or domestic violence or child neglect or abuse going on, contact the Department of Human Services and the police immediately. Not filing a report will be more damaging than filing a report. Don’t let fear dictate your safety and the safety of your children;
  6. Have a credit card handy in case of emergencies;
  7. Open up a personal bank account in your own name to protect your personal savings once you file for divorce;
  8. If you can, refinance vehicles and homes in your name or your spouse’s name. The Court will most likely not allow parties to share title or deeds. If you won’t be able to refinance after divorce, make sure to do it before you file for divorce.
